Terms of Service

These Terms of Service ("Terms") govern your access to and use of RoostWrite (the "Service") provided by RoostWrite ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and Account

You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your login credentials confidential and for all activity under your account.

2. The Service

RoostWrite generates marketing content (such as MLS descriptions, social posts, emails, and SMS copy) from inputs you provide. AI-generated output may contain inaccuracies. You are responsible for reviewing all output before publishing or sending it to clients, and for compliance with MLS rules, fair housing laws, advertising regulations, and any other applicable laws.

3. Subscription and Billing

  • Paid subscriptions are billed at $19 per month (or the price displayed at signup) through our third-party payment processor. Promotional pricing, when offered, applies as described at the time of signup.
  • Subscriptions automatically renew each month until cancelled. You authorize us to charge your payment method on each renewal date.
  • You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months unless required by law.
  • All fees are exclusive of taxes, which you are responsible for where applicable.
  • We may change pricing on at least 30 days' notice. Continued use after the change takes effect constitutes acceptance of the new pricing.

4. Free Trials and Promotions

If we offer a free trial or promotional pricing, the terms communicated at signup apply. Unless cancelled before the trial ends, your subscription will convert to a paid plan at the then-current rate.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, deceptive, or fraudulent purposes.
  • Generate content that is discriminatory, defamatory, or violates fair housing laws.
  • Submit confidential or personal information you are not authorized to share.
  • Reverse engineer, scrape, or attempt to extract source code or model weights.
  • Resell, sublicense, or share your account with others.
  • Interfere with or disrupt the Service or its security features.

6. Your Content and License

You retain ownership of inputs you submit and outputs generated for you, subject to the rights of any third-party model providers in their underlying models. You grant us a limited license to process your inputs and outputs solely to operate, secure, and improve the Service.

7. Intellectual Property

The Service, including software, design, and trademarks, is owned by RoostWrite and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Third-Party Services

The Service relies on third-party providers (including AI model providers and payment processors). We are not responsible for the availability or accuracy of third-party services.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ends immediately.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, complete, or fit for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, RoostWrite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold RoostWrite harmless from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after the changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which we are headquartered, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located there, and you consent to that jurisdiction.
